Partner Visa
Partner or Spouse migration allows Australian citizens, permanent residents and eligible New Zealand citizens to sponsor their partner (spouse, fiancé, defacto or interdependent partner) to migrate to Australia.
To be eligible for a spouse visa, you must be married, engaged to be married, in a defacto or interdependent relationship with an Australian citizen, permanent resident or eligible New Zealand citizen. In addition to this your relationship must be genuine and ongoing and you must have a mutual commitment to a shared life together to the exclusion of all others.
If your application for a spouse visa is approved, you or your spouse will be granted a provisional visa for approximately 2 years. After this 2 year period the application will be assessed against the criteria for a permanent visa. Under certain circumstances, you or your spouse may be eligible to obtain a permanent visa without the need to undertake the two year provisional visa.
As a part of the application process, you will be required to demonstrate the genuineness and ongoing nature of your relationship. You can do this by providing a range of documents and statements in support of your application. You and your spouse may also be required to attend an interview.
Your Australian partner must also agree to sponsor you and provide a legal undertaking to support you whilst holding the initial provisional visa. If your spouse is unable to provide support, you may need to find an assurer who will need to provide an assurance of support.
There are 3 (three) different types of visas available under the Partner visa category. These are,
1. Spouse Visa
In order to qualify for a spouse visa, you must be either legally married to, or in a defacto relationship with an Australian citizen, permanent resident or eligible New Zealand citizen. To meet the requirements for a defacto relationship, in most cases you must have been living together in a spouse relationship for a minimum period of 12 months.
2. Fiancé
In order to qualify for a fiancé visa, among other things, you must be engaged to an Australian citizen, permanent resident or eligible New Zealand citizen. A fiancé visa application visa can not be lodged in Australia. Once approved, you must marry your spouse within 9 months of the initial fiancé visa being granted.
3. Interdependent Partner
In order to qualify for this type of visa, you must be in a long term relationship with an Australian citizen, permanent resident or eligible New Zealand citizen and be living together. The Interdependent Partner Visa generally caters for couples in a same sex relationship..
